Offer of Light Duty Employment for Truck Driver Injured at Work in Iowa was Unreasonable

The Iowa Court of Appeals recently decided a case involving an Iowa workers compensation claim. An issue in the case was whether an Iowa truck driver could be forced to travel 850 miles to work a light duty job for the employer. The Iowa Workers Compensation Commissioner concluded that the offer of work 850 miles from the Iowa work injury employee was not a reasonable offer of work and therefore the employee was entitled to decline the work and receive Iowa Workers Compensation benefits. This decision interprets Iowa Code Section 85.33(3).
