Most of the time disputes in a Work Comp claim in Iowa are worked out by open discussions between the employee, employer and insurance company. The employer must fully explain any action taken and present supporting evidence for their decisions.
When a dispute is not settled, the employee has the right to file a contested-case proceeding which takes place before the Workers' Compensation Commissioner. Legal representation by an attorney is advisable in this situation, but not required by law.
Before initiating a contested-case proceeding, the employee is encouraged to speak with a Compliance Administrator in the Workers' Compensation Commissioner's office about other possible options.
