Who is responsible for paying benefits to an injured worker seeking Workers' Compensation in Iowa?

The responsibility of paying benefits to an injured worker lies with the employer's Workers' Comp insurance company. However, if the employer is self-insured, then it is the employer who pays the Workers' Comp benefits to the employee.

Under Iowa law if an employer fails to provide Workers' Comp insurance for its employees, they may be liable for either Work Comp benefits or for damages in a civil suit. As well, an employer must first obtain coverage for its employees before conducting any business, and could face a felony charge if they fail to do so.
