Can I Choose My Own Work Comp Doctor?

After a serious workplace injury, it’s common to feel like things are completely out of control. You’re hurt, and your workers compensation claim is in the hands of your employer. Even your medical care might be out of your control. In many cases, you’ll be sent to an employer-approved doctor for immediate treatment.

Many injured Iowa workers ask if they can choose their own work comp doctors. While the default option will be to use your employer’s chosen doctor, it’s not your only choice. In some cases, you might need a lawyer from Pothitakis Law Firm, PC to help you through the process of getting treatment from your own doctor.

Why Can’t I Use My Own Doctor?

When you’re injured, you probably need immediate medical care or at least an examination of your injuries. In most cases, your employer will have chosen a specific medical professional or group, and if you’re injured, you’ll be sent to these doctors first.

In Iowa, it’s your employers’ responsibility to provide the medical care you need to recover from your injuries. However, this also gives them a right to choose who provides that care.

Petitioning to Choose Your Care

What if you’re unsatisfied with the care you’ve received or you disagree with the assessment of the work comp doctor your employer selected? What can you do about it?

You may need to request alternate care. First, you’ll need to go to your employer and workers compensation insurer, who will process your request and decide whether to approve or deny your request.

Unfortunately, many insurance companies don’t provide options for alternate care, and you may need to contact the Iowa workers compensation commissioner about your care. You’ll apply for alternate medical care, and the commissioner will review your needs and request before making a decision.

Ask a Lawyer About Your Options

Even if your work comp claim was successful, you may still need a lawyer from Pothitakis Law Firm, PC to get the treatment you deserve. Our attorneys can help you fight for your right to choose your own work comp doctor.
