All Consequences Of A Work Related Injury In Iowa That Flow From The Original Injury Are Compensated

Pothitakis Law Firm assisted F.S. with respect to an Iowa Workers' Compensation claim against one of the largest retail operators in the country.  The Claimant had sustained an injury to her right shoulder after tripping and falling at her Iowa workplace. As a result of the right shoulder injury, the Claimant underwent multiple surgical procedures. The Claimant’s position with the retailer was a part-time position. She also held a full-time job at a heavy manufacturing facility. As a result of her injuries with the part-time retailer, she was unable to return to either job. Pothitakis Law Firm sought benefits as a result of the loss of two jobs from the Iowa work-related injury. As a result of the right shoulder injury, the Claimant was placed in an immobilizer for a period of time. Because of the use of the immobilizer, the Claimant was maintained in an awkward position resulting in strain and stress on her lower abdomen. Ultimately, the Claimant required extensive treatment and care for the abdomen from the positional injury. The Iowa Workers' Compensation insurance carrier denied the abdomen claim. No reasonable offer of settlement was made before the case was set for hearing. The parties proceeded to hearing before a Deputy Workers' Compensation Commissioner for the State of Iowa. The Deputy Workers' Compensation Commissioner found that both the right shoulder condition as well as the stomach/abdomen claim were compensable and related to the original injury. The Claimant was awarded a significant industrial disability and the Defendants were also ordered to pay all of the Claimant’s medical expenses. This resulted in an award of approximately $200,000.It is important to always note that all consequences of the original injury are compensable under the Iowa Workers' Compensation Act.
